Terms of Service
The terms that govern use of FenestraGPT.
FENESTRA TERMS OF USE
Effective Date: August 30, 2026
These Terms govern access to and use of Fenestra websites, conversational experiences, Business Assessments, transformation-design services, demonstrations, materials, and related services.
1. Fenestra Services
Fenestra helps businesses understand how their company operates and may provide services including Business DNA creation, CompanyGPT design, RoleX design, transformation roadmaps, implementation planning, and related AI transformation work.
Fenestra does not operate the customer's company. A customer's future CompanyGPT environment and related ecosystem are designed for that customer's business and may be deployed in cloud or on-premises environments depending on the engagement.
2. Business Use
Fenestra is intended for legitimate business and professional use. Users represent that they are authorized to submit information and request services on behalf of the relevant business where applicable.
3. AI-Assisted Services
Fenestra may use artificial intelligence and related technologies in providing services.
AI output may be incomplete, inaccurate, outdated, inappropriate for a specific situation, or subject to unexpected behavior.
Customers must independently review important information and retain responsibility for business decisions, approvals, commitments, regulatory compliance, customer communications, financial decisions, employment decisions, contractual decisions, safety matters, and other consequential actions.
4. No Guaranteed Results
Fenestra does not guarantee:
- increased revenue, profit, productivity, efficiency, or valuation;
- specific cost savings;
- specific automation percentages;
- specific operational outcomes;
- uninterrupted availability;
- error-free AI behavior;
- suitability of any output for a particular legal, financial, regulatory, safety, employment, or business purpose.
5. Customer Responsibilities
Customers are responsible for:
- the accuracy and legality of information they provide;
- obtaining necessary permissions and approvals;
- reviewing important AI-generated or AI-assisted material;
- configuring and operating deployed systems according to agreed requirements;
- maintaining appropriate human controls, approvals, and oversight.
6. Prohibited Use
Users may not misuse Fenestra, attempt unauthorized access, interfere with service operation, introduce malicious code, violate applicable law, infringe third-party rights, or use Fenestra to facilitate unlawful activity.
7. Third-Party Services
Fenestra may rely on third-party technology, AI providers, cloud providers, payment providers, hosting providers, communications services, and other external systems.
Fenestra is not responsible for outages, policy changes, errors, limitations, or failures caused by third-party services outside Fenestra's reasonable control.
8. Intellectual Property
Fenestra retains ownership of its pre-existing technology, methods, frameworks, designs, software, processes, terminology, and materials unless a written agreement states otherwise.
Customer rights to specific deliverables are governed by the applicable engagement, proposal, order, or written agreement.
9. Suspension or Termination
Fenestra may suspend or restrict access where reasonably necessary for security, abuse prevention, legal compliance, nonpayment, or material violation of these Terms.
10. Disclaimer
The service is provided subject to applicable law and the terms of the relevant engagement. Fenestra does not warrant that every AI-generated or AI-assisted output will be correct, complete, current, or suitable for a customer's intended purpose.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Fenestra and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost business opportunities, loss of goodwill, or loss of data arising from use of or reliance on Fenestra services or AI-generated or AI-assisted output.
Any additional limitations applicable to a paid engagement may be stated in the relevant agreement.
12. Changes
Fenestra may update these Terms. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
13. Governing Terms
Specific proposals, statements of work, order forms, or signed agreements may contain additional terms. If there is a conflict, the signed agreement controls for that engagement.
